An invention shall be patentable if it is novel, involves an inventive step and is industrially applicable.
Procedure for applying for a patent, whether being in Malta, in the EU or worldwide, is based on documentation. The applications are similar and have common requirements which include:
(a) a request for the grant of a patent;
(b) a description of the invention;
(c) one or more claims (most important part);
(d) any drawings referred to in the description or the claims;
(e) an abstract of the invention.
Procedure in Malta
One must file an application and fill in the details of such application.
The application shall be examined in order to determine whether the application complies with the requirements laid down in the Act and in the regulations. The applicant shall be given the opportunity to amend the application in order to comply with the requirements. If the application has originally filed or as amended complies with all the formal requirements the Comptroller shall grant a patent on the application. An appeal may also be filed to contest the refusal of the application.
Procedure for registering a patent in the EU or Internationally.
Registering a patent outside our local jurisdiction is also possible. Malta is a member of the European Union and also a signatory of the Patent Cooperation Treaty.
